All content, features, and functionality of OnHealth, including but not limited to text, graphics, logos, icons, images, software, and the overall design, are owned by OnHealth and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
8. User Content
You retain ownership of any content you submit to OnHealth (such as meal photos or notes). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content for the purpose of providing the Service.
You represent and warrant that you own or have the necessary rights to submit any content and that your content does not violate any third-party rights.
9. AI-Generated Content
OnHealth uses artificial intelligence to generate meal plans, recipes, and nutritional analysis. You acknowledge that:
- AI-generated content may not always be accurate or suitable for your specific needs
- Nutritional estimates from photo analysis are approximations
- You should verify important nutritional information, especially if you have allergies or health conditions
- AI suggestions should not replace professional dietary advice
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONHEALTH AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, or goodwill
- Any damages resulting from reliance on nutritional information or meal plans
- Any health issues or adverse reactions from following our recommendations
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless OnHealth and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
You may terminate your account at any time through the app settings or by contacting us.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in fraudulent or illegal activity.
Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
